Employment Relations Centre Limited (here in referred to as ERC) is the provider of web based services including courses, downloadable content and support.

ERC is the intellectual property owner of the full contents of employmentrelations.co.nz, including all documentation, text, designs, trademark and graphics. Unless otherwise outlined elsewhere in the terms of use no part of the service or materials may be reproduced, modified, translated or adapted in any way.

Trade Mark

You acknowledge that HPtE Strategy®, MYMindset®, MYLeadership® and MYCoaching® are trademarks of ERC.  No part of the trade mark may be reproduced, modified, translated or adapted in any way.

Your undertaking

You will:

- Not copy the service, documents and information or reproduce any of the services of ERC other than for your own use.

- Not copy or use any aspects of the service in an on-line system without first obtaining a permission from ERC.

- Not use the service in any manner that infringes our intellectual property rights.

- Not print out any part of the website or service in order to provide any element of the service to another person outside your own company.

- Manage the use of this service among your nominated users and ensure that they are aware of the terms of use.

Warranty

You acknowledge that the service is not error-free and agree that the existence of any errors shall not constitute a breach of any service offered.

If you discover an error, ERC will make all reasonable efforts to correct that error except where the error has been caused by incorrect use or abuse of the service.

ERC does not warrant that the service is fit for any particular purpose where the service has been acquired for business purposes.

Although ERC has taken all reasonable steps to ensure that the commonly known viruses are not contained within the documentation, you are responsible for checking all documents for viruses on downloading.

Payment

Documents and courses can be accessed on payment by credit card of the correct amount.  All charges will be made in $NZ Dollars. No refunds will be allowed unless the document or service is not provided in which case the ERC shall supply the service or give a refund in full.

In the event of non-delivery of a document or service ERC can be contacted by email by submitting an enquiry.

ERC and/or its agents will not be held liable and/or accept any responsibility to you for damages, incidental or consequential, of any nature whatsoever.

Members and clients including associated members and clients shall not, without the written permission of ERC, resell or make available to any third party any such services as they may receive from ERC. Only the registered client and nominated users are authorised to use the account.

ERC reserves the right to withhold access to its service for any overdue amounts, while you shall continue to be liable for the costs of services until the conditions of notice of termination (where applicable) are fulfilled.

ERC reserves the right to recover any arrears amounts on unpaid and/or returned Credit Card or Debit Order fees by submitting such arrears by the next Credit Card or Debit Order activation date.

ERC provides its services ONLY on the basis that the you have read, understood and accepted these Terms of Use for ERC services.

Law

Use of this web site and these Terms shall be subject only to the laws of New Zealand, which will exclusively govern the application, and effect of all the above permissions, exclusions, licences and conditions of use. The Courts of New Zealand shall have exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with this web site and its use and these Terms.
